I'm not trying to be politically partisan, but the writers of that letter to the CDC happen to be in the same political party as the one currently in control of the WH and congress, as opposed to the people who are initiating lawsuits and bringing forward "theatrical legislation".
That letter will hold more weight, and they will do whatever the people in charge tell them to do (within reason of course). In fact, I wouldn't be surprised if the head of the CDC ASKED them to write the letter in order to give them political cover. That's how things work in their world.
